Licenties bewaren we zolang je account bestaat. Betalingen bewaren we 7 jaar (artikel 52 Algemene wet inzake rijksbelastingen).
We maken elke nacht een back-up.
Responsible for your data (the "controller", GDPR) is:
RainPlotWe have no data protection officer. None is required (GDPR article 37): we are not a public body, we do not monitor people on a large scale and we do not process special categories of data, such as health data.
For each kind of data: what, what for, the legal basis (GDPR article 6(1)) and how long we keep it.
Your e-mail address, your password as a hash (argon2id, never the password itself), your language, the version of the terms you accepted, when you signed up and confirmed, and when you last used Rainplot. Purpose: your account. Legal basis: the contract (point b). Without an e-mail address and a password you cannot have an account. Kept until you delete your account. A free account that never had a pass and has not been used for 24 months is deleted; you get a warning by e-mail 30 days before.
Sessions (stored as hashes, with start and end; a session lasts 30 days) and the links in our e-mails (as hashes; a confirmation link is valid for 24 hours, a password link for 6 hours). Purpose: keeping you logged in and securing your account. Legal basis: the contract (point b). Kept until they expire or you log out.
How much free time you used, when it started and the counter's last beat. The server also counts by itself the minutes in which you loaded the map close up: only the number and the first time, no places. Purpose: counting the free time. Legal basis: the contract (point b).
This record belongs to your mailbox, not to your account. We keep it under a keyed hash (HMAC) of your simplified e-mail address (lower case, without a +tag, at Gmail without dots), never under the address itself. It stays when you delete your account, so that a new account gives no new free time. Legal basis for that: our legitimate interest in fair use of the free time (point f); you can object to it (article 8). This is pseudonymised personal data (GDPR recital 26), not anonymous data: the key is in the same database, so whoever has a copy can check whether a given address ever had an account. Kept until 24 months after its last use.
A pass: the point you bought it for (coordinates), the pass's label (the coordinates of your design's centre and the number of sprinklers), start and end. A payment: amount, status, Mollie's number, the point and the label, and the time. Purpose: providing the pass, and our accounts. Legal basis: the contract (point b) and the tax duty to keep records (point c). Passes are kept as long as your account exists. Payments are kept for 7 years (Dutch tax law, article 52 AWR). Unfinished payments are deleted after 30 days.
With every payment we also keep the evidence of your choices at checkout: when you confirmed that Rainplot gives estimates, when you chose to start at once, the version of the terms and your IP address. Legal basis: our legitimate interest in disputes and chargebacks (point f). The IP address is deleted 24 months after the payment; the rest is kept as long as the payment.
If you delete your account, the payment keeps the amount, the status, Mollie's number, the pass's label (the coordinates of your design's centre and the number of sprinklers) and the evidence above. It no longer keeps your account or the pass's point.
Saved designs: the design, its name, the address and drawings or photos you imported (up to 50 MB per account). Purpose: saving. Legal basis: the contract (point b). Kept until you delete the project or your account.
For each pass and day we count the runs you started. Legal basis: the contract (point b). For each run we keep a copy of the project for 90 days, including the address and imported drawings, and the settings as the planner read them. After that we delete the copy. The run's log record is kept for 1 year, not anonymised: your account, your licence, the project name, the settings and the results (duration, outcome, metrics). We use it to improve the planner and to help you with a question or a fault. Only our own administrators can see it. Legal basis: our legitimate interest (point f); you can object to it (article 8).
Purpose: protecting our database and software and enforcing the licence. Legal basis: our legitimate interest (point f).
Our server keeps a log: for refused or failed requests the IP address, the time, the path and the outcome; for failed logins, lockouts and limits also a short keyed code of the account, never the e-mail address; for logged-in requests sometimes your account number. Purpose: security, preventing abuse and fixing faults. Legal basis: our legitimate interest (point f). Kept for 90 days, then deleted automatically.
When you search for an address, our server sends your search text to both PDOK (Netherlands) and Nominatim (OpenStreetMap), unless we already hold the answer (see below). If Nominatim is busy, our server may skip it. Our server fetches map images from the providers named on the map, such as government agencies and Esri. These services see your search text or the map area (often your own address), but not your IP address, your name or your account. Our server keeps search answers for 24 hours, without a link to you. To limit the use of map images we count per account and per IP address for one day, in memory only.
If you e-mail us, we use your message and address to help you. Legal basis: the contract or our legitimate interest (point b or f). Kept as long as needed for your question, at most 2 years.
Both cookies are strictly necessary for the service, so we do not ask for consent (Dutch Telecommunications Act, article 11.7a(3); ePrivacy Directive, article 5(3)). We use no other cookies and no third-party cookies.
Your browser also keeps data itself (local storage and IndexedDB): your draft design, settings, your language and imported drawings. They stay on your device. You can clear them in your browser's settings.
Our processors are in the EEA. Two services outside the EEA receive a search text or map area from our server, without your IP address, name or account:
We make a backup every night. Deleted data therefore stays in backups for at most 5 weeks. After that it is gone.
You have the right to object to any processing based on our legitimate interest (GDPR article 21): the free-time record, the payment evidence, the export log, the server log, the planner data and the protection of the library. E-mail us. We then stop, unless we have compelling legitimate grounds that weigh more. For the free-time record that is preventing a new free period with the same address.
We answer within one month. We may ask you to show that the account is yours. Do you disagree with us? Then you can complain to the Dutch Data Protection Authority, the Autoriteit Persoonsgegevens (autoriteitpersoonsgegevens.nl).
We take no decisions about you based solely on automated processing that have legal effects (GDPR article 22). Limits such as the free time are technical limits from the terms.
If something still goes wrong with your data (a data breach), we report it to the Autoriteit Persoonsgegevens within 72 hours where the GDPR requires it, and to you if the risk to you is high (GDPR articles 33 and 34).
We may change this notice. Every version has a number. For important changes we e-mail everyone with an account beforehand.
